  • Agreement: Refers to the contract between the Company and the Client that outlines the specific terms of service, including duration, capacity, pricing, and responsibilities.

2. Acceptance of Terms

By using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree to these Terms, you must refrain from using our services.

3. Services Provided

Colos Complex Logistics offers tank storage, terminal handling, transshipment, and other associated logistics services. The services provided will be outlined in the service agreement, including the nature of the product, storage duration, and any additional services.

4. Pricing & Payment Terms

  • Pricing: All fees and charges are specified in the individual service agreements and may vary based on the nature of the services, duration, and market conditions.
  • Payment Terms: Invoices are issued on a regular basis, and payment must be made within the timeframe stipulated in the service agreement. Late payments may incur interest charges as outlined in the agreement.
  • Currency: All payments must be made in the agreed-upon currency unless otherwise specified.

5. Storage Conditions

  • Product Specifications: Clients must provide accurate product details and specifications before storage, including any hazardous properties, to ensure proper handling and compliance with safety regulations.
  • Product Handling: Colos Complex Logistics is responsible for the safe handling, storage, and transshipment of products as per the specifications agreed upon.
  • Compliance: All products stored in our facilities must comply with local, national, and international regulations regarding safety, environmental, and legal standards.

6. Liability & Insurance

  • Company Liability: Colos Complex Logistics will take reasonable steps to protect your products while in storage. However, we are not liable for any loss, damage, or delay resulting from events beyond our control, including but not limited to natural disasters, strikes, or government actions.
  • Client Responsibility: The Client is responsible for providing insurance coverage for their products while in storage. Colos Complex Logistics will not be held liable for any loss or damage unless caused by our own negligence or willful misconduct.
  • Insurance: Clients are required to maintain sufficient insurance for their products during the storage and transshipment period, including coverage for fire, theft, and environmental hazards.

7. Termination

  • Termination by the Company: Colos Complex Logistics reserves the right to terminate services at any time if the Client fails to adhere to these Terms and Conditions or the specific service agreement. Termination will be communicated in writing.
  • Termination by the Client: The Client may terminate services upon providing the required notice period, as specified in the service agreement.
  • Post-Termination Obligations: Upon termination, the Client is responsible for removing their products from our storage within the timeframe specified. Failure to do so may result in additional charges.

8. Force Majeure

Colos Complex Logistics will not be liable for delays or failure to perform any part of its obligations under these Terms due to events beyond its reasonable control, including but not limited to natural disasters, war, acts of terrorism, labor strikes, and government restrictions.

9. Confidentiality

Both parties agree to keep all information related to the service agreement confidential and not disclose it to any third party without written consent, except where required by law.

10. Environmental & Safety Compliance

Colos Complex Logistics complies with all applicable environmental and safety regulations. Clients must also ensure that their products and operations conform to all relevant legal standards to avoid penalties or disruptions in service.

11. Dispute Resolution

  • Governing Law: These Terms and Conditions are governed by and construed in accordance with the laws of the jurisdiction where the service is provided.
  • Dispute Resolution: Any disputes arising from these Terms will be resolved through negotiation. If a resolution cannot be reached, the matter will be submitted to arbitration, as outlined in the service agreement.

12. Amendments

Colos Complex Logistics reserves the right to amend these Terms and Conditions at any time. Clients will be notified of any changes, and continued use of our services following such notification will constitute acceptance of the amended terms.
